Please read these Terms of Service ("Terms") carefully before using Agentkith ("the App", "the Service"). By downloading, installing, or using Agentkith you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract in your jurisdiction to use Agentkith. By using the Service you represent that you meet these requirements.
2. License
Subject to these Terms, Agentkith grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal or internal business purposes.
You may not: sublicense, sell, or redistribute the App; reverse-engineer or attempt to extract source code; use the Service to build a competing product; or remove any proprietary notices.
3. Accounts
You are responsible for all activity that occurs under your account. Keep your credentials confidential and notify us immediately at [email protected] if you suspect unauthorised access.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Transmit malware, spam, or otherwise harmful content.
- Infringe the intellectual property rights of others.
- Interfere with or disrupt the integrity of the Service.
- Attempt to gain unauthorised access to any system or network.
5. Subscriptions and Billing
Paid features are offered on a subscription basis. Prices and billing cycles are described at checkout and may be updated with 30 days' notice. All charges are in USD unless stated otherwise. See our Refund Policy for details on cancellations and refunds.
6. Intellectual Property
Agentkith and its licensors own all right, title, and interest in the Service, including all software, branding, and documentation. These Terms do not transfer any ownership to you.
You retain full ownership of any code, content, or other materials you create using the Service.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Third-Party AI Providers
Agentkith integrates with third-party AI providers (e.g. Anthropic, OpenAI). Your use of those integrations is subject to the respective provider's terms and policies. We are not responsible for the outputs or availability of third-party models.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, AGENTKITH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENTKITH'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL AGENTKITH BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
11. Termination
We may suspend or terminate your access if you breach these Terms, with or without notice. You may terminate your account at any time. Upon termination, your license to use the Service ends immediately.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use after the effective date constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the courts of Delaware.
